The situation of 'mule women' and the Schengen evaluation report

1. The Charter of Fundamental Rights is only binding for EU Member States when they are implementing corresponding Union law. The EU has enacted occupational safety and health laws and Spain must implement them.
At the EU level, the Commission Communication on "Safer and Healthier Work for All - Modernisation of the EU Occupational Safety and Health Legislation and Policy" highlights the need to effectively apply and enforce EU rules on Occupational Safety and Health on the ground and sets out actions to help business and Member States to comply with and enforce these rules. These include, for example, peer reviews among Member States for the exchange of good practices and the development of guidance documents to support labour inspectors and employers.
It is up to the competent national authorities of the Member States to ensure enforcement of these rules in the EU territory.
2. The adoption of the Schengen evaluation report of the application of the Schengen acquis in the field of management of the external border by Spain is still ongoing, with a foreseen adoption date in the third quarter of 2018.
