« Par cet amendement, nous souhaitons nous opposer à l'introduction de ce nouvel alinéa, qui met en place , s’agissant des obligations qu’appliquera le CSA, une contrainte pour les plateformes qu'il régule. A l'instar de la Quadrature du Net , nous estimons que cette nouvelle disposition issue de la rédaction du Sénat donne des pouvoirs supplémentaires et disproportionnés aux plateformes, en leur demandant de déterminer seules le « faisceau d’indices » indiquant une « contravention sérieuse aux infractions » visées. Cette modification dangereuse prend également maladroitement pour acquis la nécessité d'avoir un compte pour s'exprimer sur une plateforme, alors qu'il est tout a fait possible de publier sur une plateforme sans en avoir un. »
